Wine Club Membership Terms & Conditions
Eligibility & Age Verification
- Membership is open only to persons 21 years of age or older.
- By enrolling, you confirm you meet the legal drinking age and agree to comply with all applicable alcohol laws.
Pickup vs. Shipping
Pickup (Preferred Option):
- Wines will be held for pickup at the vineyard. You will be notified when your allocation is ready.
- Wines held for pickup will be stored for up to 30 days (unless mentioned otherwise). After that period, if not claimed, we reserve the right to either ship the wines (with shipping fees) or substitute equivalent bottles, at our discretion.
- Member benefits (discounts, events, etc.) may require you to pick up in person.
Shipping (Texas Residents Only):
- We offer shipping exclusively within Texas (where legally permitted).
- A flat shipping charge of $25 per shipment will be added.
- Shipments occur February, May, and October.
- All shipments require an adult (21+) signature at delivery. No P.O. boxes allowed.
- If a shipment is returned, refused, or undeliverable, you will be responsible for return, re-shipping, and handling fees.
- If extreme weather may compromise wine quality, we reserve the right to delay shipping to ensure safe delivery.
Billing & Notifications
- You will receive an email notification at least 7 days before each upcoming charge, with details of your wine allocation and any shipping fees.
- By providing your payment method, you authorize automatic charges for your club allocations, shipping, taxes, and any additional wines you order as add-ons.
- You are responsible for maintaining valid, up-to-date billing information. If a charge fails, your membership may be suspended until resolved.
Skips / Holds / Pause Options
- You may request to skip up to two shipments in any 12-month period.
- Requests to skip or pause a shipment must be submitted at least 10 days prior to billing.
- During a skip/hold, membership benefits (discounts, event access) may be suspended for that cycle.
Cancellation / Termination
- You may cancel your membership after receiving a minimum of two (2) shipments, with 30 days’ advance written notice (via email or in writing).
- Cancellations made fewer than 30 days before a scheduled shipment will be processed after that shipment.
- Once an allocation is processed (charged and prepared), no refunds will be issued.
- We reserve the right to suspend or terminate membership for nonpayment, violation of terms, or changes in law/regulation.
Substitutions & Allocation Adjustments
- Due to harvest variability, we may substitute a wine of equal or greater value if your selected vintage or varietal becomes unavailable.
- Allocation dates are estimates and may shift slightly due to production, logistics, or weather.
- We may modify club pricing, shipping fees, or benefits with advance notice; your continued membership will constitute acceptance of the new terms.
Liability & Disclaimer
- All wines are provided “as is.” We disclaim all warranties, expressed or implied, including merchantability or fitness for a particular purpose.
- We are not liable for damage, loss, or delay in transit beyond our control (e.g. carrier issues, weather, legal restrictions).
- Our liability for any issue (defective wine, delivery problems) is limited to remedying that specific shipment (e.g. replacement), not broader damages.
Legal & Regulatory Compliance
- Membership benefits and shipping are contingent on compliance with all applicable federal, state, and local wine laws.
- If laws change or distribution to a state becomes restricted, we may convert your membership to pickup-only or allow you to cancel and refund unused allocations (less processing costs).
- You may not resell wines received through the club — they are for personal consumption only.
Communication & Address Changes
- Notifications, invoices, and club communications will be sent via email. Check spam/junk folders.
- To change your address, billing info, or membership level, notify us 15 days in advance of the next billing cycle or update your club membership account on our website.
- Changes submitted after that window may not take effect until the following cycle.
Governing Law & Dispute Resolution
These Terms are governed by Texas law.
Any dispute arising from membership will be resolved in Texas courts (venue of your county or agreed location).
